INSTALLATION AND OPERATION OF BQ LINK INTERNET SERVICE

GENERAL
The internet is not a commercial service but a cooperative community of computer users. A BQ Link subscriber automatically becomes a member of this community. To become a member in good standing, a subscriber must:

•	Understand normal etiquette and promote the efficient use of the network by minimizing unnecessary network traffic. Check local services before accessing those at distant sites.
•	Not take any action that would disrupt BQ Link as a whole or any equipment, or service provided over it by any other network it connects to.
•	Not attempt unauthorized entry into any network or computer system.
•	Not transmit any message which may be offensive or in violation of any applicable law or regulation.
•	Not engage in mass distribution of any message. Messages may not be "broadcast" or otherwise sent in an unsolicited or intrusive manner.

RATES
Subject to further revisions, modifications or amendments by BQ Megabyte the latest schedule of rates and charges in effect shall be imposed for this service. For this service charge, rental for instrument if any and usage excess monthly charge per month shall apply. A change in rates is applicable on and from its effective date notwithstanding the fact that the subscriber may have been billed and/or have paid in advance at the previous rate.

The use of the Internet Service up to the extent of the respective free usage allocation per month shall be free of charge to the subscriber. However, usage rate for every hour in excess of the free allocations of local calls shall be subject to the applicable rates of the BQ Link rates schedule.

All unused free usage allocations for any particular month, shall not be applied to the succeeding months.

RESPONSIBILITY OF THE INTERNET ACCOUNT
Subscriber shall be liable for the usage of his Internet Account regardless of who may make use of it. Non-payment of these bills or refusal on the part of the subscriber to pay his bills arising from Internet use shall be sufficient ground for BQ Megabyte to discontinue subscriber's service.

BILLING AND PAYMENTS
Bills for Internet service will be rendered at regular intervals. Subscriber agrees to pay on or before the date specified in the billing invoice. Payment shall be at the office of BQ Megabyte of to a duly authorized collector of BQ Megabyte.

Any complaint regarding a billing invoice/statement shall be made in writing by the subscriber within five (5) days from receipt thereof. Otherwise, the billing invoice/statement shall be deemed correct.

Any and all notices to subscriber shall be in writing and shall be deemed to have been duly given if delivered in person, or upon the expiration of the five (5) days after mailing. Such notices shall be sent to the subscriber's billing address or at a such address as may subsequently be given by the subscriber to BQ Megabyte. Subscriber shall duly inform BQ Megabyte in advance and in writing, or any change in the billing address.

Bills which remain unpaid after the lapse of the period for payment shall bear at the rate of 60% per annum.

In cases where collection is made by or through an attorney-at-law or collection agency, subscriber shall pay twenty-five percent (25%) of the amount due as collection of attorney's fees, in addition to costs and other litigation expenses.

Subscriber agrees that all payments shall be applied first to bills in arrears, including interest and penalties, the balance, if any to be applied to the current obligation.

TRANSFER OF SERVICE
Subscriber agrees not to transfer or assign this Agreement or any right or interest originating therefrom to any person or entity without prior written approval from BQ Megabyte. The Subscriber shall be liable to pay all accrued charges pending approval. Upon approval of the same, the transferee or assignee shall be liable for any and all charges due to the account.

TECHNICAL SUPPORT
BQ Megabyte shall provide BQ Link service-related technical service assistance to Subscriber in all circumstances other than those that fall under the following:

DISCONNECTION/TERMINATION OF SERVICE
BQ Megabyte reserves the right to suspend or disconnect without prior notive of Subscriber in the following instances:

Disconnection of service shall become permanent upon failure of the subscriber to correct/rectify the ground/s for discontinuance of service within ten (10) days from temporary disconnection. In case of restoration of service, subscriber shall be liable for all applicable fees and charges.

In case service is discontinued or terminated for any reason whatsoever, all unpaid bills or charges shall immediately become due and demandable.

In the event of termination/cancellation of service for any reason whatsoever , subscriber undertakes to inform BQ Megabyte in writing of such request. All unpaid bills or charges relative to such account shall immediately become sue and demandable.

Any change of subscription plan within the period covered by this Agreement shall be subject for approval of BQ Megabyte and the payment of applicable fees and charges, if any.

VENUE
Venue of any or all arising from this Agreement or any other suit directly or indirectly arising from the contractual relationship between BQ Megabyte and subscriber shall exclusively be lodged in the proper courts of Tagbilaran, Bohol, subscriber hereby expressly waiving all other applicable venues.

AMENDMENTS
These terms and conditions shall be subject to amendment, change or modification by BQ Megabyte as the needs or exigencies of the service price may acquire.

Pertinently, all other documents and/or agreement which may hereafter or executed by BQ Megabyte and/or the Subscriber directly or indirectly related to this Agreement shall form part hereof and shall be subject at all times to the provisison stated herein.
